Where the SOP is already wrong

SOP 50 10 8 permits owners who are U.S. citizens, U.S. Nationals OR Lawful Permanent Residents, and devotes Section A, Chapter 1.F to verifying LPR status — I-551 cards, I-327 re-entry permits, I-797 notices. Policy Notice 5000-876441 removes LPRs from that list entirely, requiring 100% U.S. Citizens or U.S. Nationals with a U.S. principal residence, and rescinds the 5% foreign-ownership exception. Reading the SOP alone gives you an eligibility test that is broader than the one SBA now applies.

SBA is requiring that 100% of all direct and/or indirect owners of a small business applicant be U.S. Citizens or U.S. Nationals who have their Principal Residence in the United States, its territories, or possessions. Effective March 1, 2026, this Notice rescinds SBA Procedural Notice 5000-872050, removing the narrow exception that allowed a Borrower to have up to 5% ownership held by foreign nationals.
