2. 7(a) Small Loans a. All General Requirements in this Appendix apply to 7(a) Small Loans except as modified below. b. 7(a) Small Loans of $50,000 or less c. For 7(a) Small Loans of $50,000 or less, collateral is not required. Lenders may, but are not required to, take additional collateral consistent with their own policies and procedures. d. 7(a) Small Loans greater than $50,000, the General Requirements apply, subject to this section. i. Lender must take a first lien on assets financed with loan proceeds, except where this Appendix does not require a lien on certain vehicles or permits a subordinate lien for improvements to existing assets. ii. Working Capital: When 50 percent or more of the loan proceeds will be used for working capital, the Lender must take a lien on all fixed assets of the Applicant business, including real estate, up to the point the loan is fully secured, using the valuation limits set forth in Paragraph B., 1., b. in this Appendix, and paragraph B., 1., b. Loan must be fully secured. e. Additional collateral lenders may choose to take i. For 7(a) Small Loans, SBA only requires the collateral described in Paragraph 2., b-2.c. However, SBA does not prohibit a Lender, consistent with its own policies and procedures, from taking additional collateral, including but not limited to: a) Available equity in personal real estate (residential and investment property) of any owners and guarantors. b) Trading assets of the Applicant business. c) Commercial, residential, or investment real estate owned by the Applicant or personally by the owners or guarantors.
