7. Export Working Capital Program (EWCP) Loans a. All general debt refinancing requirements apply to EWCP Loans with the following exceptions: i. The loan being refinanced must be terminated after it is paid off with EWCP loan proceeds. ii. Lenders may use delegated or non-delegated authority to refinance existing SBA 7(a) guaranteed loans (whether term or line of credit) including existing export-related SBA Express, CAPLine, EWCP, and Export Express and export lines of credit. This includes SBA 7(a) guaranteed same institution loans where there are export sales and only the export collateral may be used to refinance same institution debt. All refinanced debts must be fully supported by active export sales or pending export orders, and the EWCP terms and conditions in the SBA Loan System must specify additional eligible uses of loan proceeds for subsequent draws. iii. Any business debt refinanced with a EWCP loan must be supported by eligible collateral under a Borrowing Base Certificate or Transaction-Based loan. iv. The following types of loans are not eligible for delegated processing, and as such must be submitted for non-delegated processing through the Loan Guaranty Processing Center (LGPC): a) Loans involving a Single Employer 401(k) plan, including Rollovers as Business Start-Ups (ROBS) plan, unless the only investment held by the 401(k) plan at the time of application is the equity in the Applicant business; and b) Loans involving a Multiple-Employer 401(k) plan (i.e., a plan that holds in trust the assets of other businesses), including a ROBS plan (see SOP 50 10, Section A, Ch. 2, Para. D., 401(k) Plans Including Rollovers as Business Start-Ups (ROBS) Plans, for more information). v. Prior to the first disbursement, the Lender must ensure: a) Collateral for the loan being refinanced is transferred to secure the EWCP loan. b) Any outstanding receivable that would have been applied to pay down the refinanced loan must be applied to pay down the EWCP loan in the same or greater percentage. vi. Except as stated in the next sentence, if the debt to be refinanced was used in whole or in part to refinance a prior debt, the loan being refinanced, including the associated interest, must be reflected on the Applicant’s balance sheet and business tax returns (Schedule C for sole proprietorships) for two full tax cycles prior to application. If the term of the debt to be refinanced is less than the period of two full tax cycles prior to application, the loan being refinanced, including the associated interest, must be reflected on the Applicant’s balance sheet and business tax returns for the full tax cycle(s) that occurred between the date of disbursement of the loan being refinanced and the date of application for the EWCP loan.
