Gormley, President SUBJECT: Authorization of Electronic Execution, Submission, and Retention of form HUD 11711A This All Participants Memorandum (APM) authorizes electronic execution, submission, and retention of form HUD 11711A – Release of Security Interest (HUD 11711A). The Lending (or Other Financing) Institution may execute the form electronically, Issuers may deliver the form electronically, and Document Custodians may retain the form electronically. This APM also establishes requirements for the electronic signature, submission, and retention of authorized forms. Effective for pools with an issue date on or after October 01, 2026, form HUD 11711A may be executed, submitted, and retained electronically in accordance with Chapter 1, Part 12 of the Ginnie Mae Mortgage-Backed Securities Guide 5500.3, Rev-1 (MBS Guide). As of that date, this APM shall replace APM 20-01: Temporary Use of Digital Signatures on form HUD 11711A and form HUD 11711B – Certification and Agreement (HUD 11711B), published on 03/25/2020 and APM 21-02: Continued Temporary Use of Digital Signatures on form HUD 11711A and form HUD 11711B, published on 07/07/2021. Ginnie Mae will accept electronic signatures (eSignatures) on form HUD 11711A, as defined by the Electronic Signatures in Global and National Commerce Act (ESIGN Act), 15 U.S.C. § 7001 et seq, and with all other applicable federal and state law. However, as an operational requirement, the electronic signature may not consist of an audio recording, a video recording, or be comprised exclusively of biometric data. The electronic signature utilized on forms must, in all cases, be performed, affixed, or reflected as to allow a person reading the form to identify the first and last name and title of the signer. The electronic signing process must generate a signature audit trail, and the audit trail must be appended to the executed form so that the form and audit trial are delivered, submitted, and retained as a single file. Any HUD 11711A form signed electronically must also be submitted and retained electronically between lending (or Other Financial) Institutions, Issuers, and Document Custodians. Issuers are responsible for ensuring that the electronic signature of any Lending (or Other Financing) Institution choosing to execute, submit, and retain form HUD 11711A electronically meets the requirements set forth in Chapter 1, Part 12 of the MBS Guide. 2 2 The requirements mentioned in this APM are not exhaustive. Program participants must follow Ginnie Mae’s official set of requirements for electronic execution, submission, and retention of MBS Program documents. Detailed guidance can be found in Chapter 1, Part 12 of the MBS Guide. Ginnie Mae is exploring modernization of its requirements for forms and appendices used in its MBS Program. Additional guidance will be issued as documents become eligible for electronic execution, submission, and retention. The tables below outline eligible forms and appendices for electronic execution, submission, and retention, as well as revisions to the MBS Guide for this enhancement. Please note that Issuers will continue to execute and submit form HUD 11711B electronically through Ginnie Mae systems using authenticated user credentials.
