(04/08/26) This section contains requirements related to: ■ Scope and applicability ■ Definitions ■ Limitation on Authorized Users ■ Relation to Chapters 8301, 9203, 9204, 9206, 9209, 9210 and 9301 (“Loss Mitigation Business Rules”) ■ Consumer Credit Data; Limited Agency ■ Additional representations and warranties ■ Conditional waiver liability (a) Scope and applicability Resolve® is the System licensed pursuant to this System-Specific License and the Master Systems License. Immediately upon a User’s first access to Resolve on or after the Effective Date, the Seller/Servicer shall be bound by this System-Specific License and the Master Systems License. This System-Specific License is incorporated into and made a part of the Master Systems License by this reference. Any reference herein to the System-Specific License shall be deemed to include this System-Specific License and the Master Systems License. (b) Definitions The definitions below apply for purposes of this System-Specific License. Any capitalized term used but not defined in this System-Specific License shall have the meaning set forth in the Glossary, the Master Systems License (Chapter 2401) or elsewhere in the Guide. (c) Limitation on Authorized Users Notwithstanding anything to the contrary in Section 2401.1, only employees of a Seller/Servicer, a Servicing Agent or other Related Third Party shall be Authorized Users under Section 2401.1, the Guide and other Purchase Documents. Accordingly, and for the avoidance of doubt, Seller/Servicer shall provide or make access to the System available only to its employees, employees of its Servicing Agents and other Related Third Parties, subject

404-9 to the limitations and requirements of Section 2401.1, the Guide and other Purchase Documents. (d) Relation to Chapters 8301, 9203, 9204, 9206, 9209, 9210 and 9301 (“Loss Mitigation Business Rules”) This Section 2404.3 is in addition to and not in limitation of the Loss Mitigation Business Rules, which address various rights and obligations associated with Servicer’s loss mitigation and other Servicing undertakings on behalf of Freddie Mac by means of the System. Notwithstanding the foregoing: i. The Seller/Servicer may not deem Freddie Mac to have reviewed the terms of any approved loss mitigation solution for compliance with the Seller/Servicer’s obligations under the Guide or other Purchase Documents, or to have approved any loss mitigation solution or their terms based on the Seller/Servicer’s use of the System, including, without limitation: ■ The System’s generation of terms for any reinstatement, relief, retention or liquidation solution, ■ Freddie Mac’s settlement in its systems of any such solution entered into by the Seller/Servicer under its delegated authority or expanded delegated authority in accordance with a Freddie Mac approval of an exception, or ■ Freddie Mac’s notification that the loss mitigation solution has been processed in Freddie Mac’s systems via the Loan Modifications processed report or the Charge Off processed report ii. The Seller/Servicer may not deem Freddie Mac to have reviewed the terms of a Trial Period Plan or modification agreement for compliance with the Servicer’s obligations under the Guide or other Purchase Documents or to have approved a Trial Period Plan or modification or their terms based on the Seller/Servicer’s use of the System including, without limitation: ■ The System’s generation of terms for a Trial Period Plan or modification agreement ■ Freddie Mac’s settlement on its systems of a modification entered into by the Servicer under its delegated authority or expanded delegated authority in accordance with a Freddie Mac approval of an exception, or ■ Freddie Mac’s notification that the modification has been processed in Freddie Mac’s systems via the Loan Modifications Processed report (e) Consumer Credit Data; Limited Agency

404-10 1. In connection with its use of the System as permitted in the Documentation, the Seller/Servicer may obtain and/or access consumer credit data as that term is defined in State and federal fair credit reporting laws (i.e., "Consumer Credit Data"), including through requesting and obtaining consumer credit reports in which Consumer Credit Data is embedded (each, a "Credit Report") from a credit repository or credit bureau (each a "Credit Reporting Agency"). 2. With respect to any Credit Report or other Consumer Credit Data obtained and/or accessed by or through the System, the Seller/Servicer hereby: i. Certifies that it has a permissible purpose under applicable State and federal fair credit reporting laws to use the Credit Report and/or other Consumer Credit Data, ii. Authorizes the System, on behalf of the Seller/Servicer, to retrieve, process, assess and/or store the Credit Report and/or other Consumer Credit Data, and/or share the Credit Report and/or other Consumer Credit Data with its Related Third Parties, iii. Appoints the System as its limited agent for the sole purpose of having the System effect such Credit Report and/or other Consumer Credit Data retrieval, processing, assessment, storage and/or sharing with the Seller/Servicer and/or its Related Third Parties, and iv. Ratifies and affirms its compliance with (a) the federal Fair Credit Reporting Act and its implementing regulations, and (b) any applicable State law and regulation 3. This System-Specific License does not create any principal or agency relationship other than the limited agency set forth herein, and (except with respect to its agency relationship required under Section 2401.1(e)(iii) of the Master Systems License) the Seller/Servicer shall not assert or represent to any third party the existence of any other principal or agency relationship arising from or in connection with this System-Specific License or otherwise 4. The Seller/Servicer acknowledges and agrees that Credit Reports and any other Consumer Credit Data constitute System Data for purposes of Chapter 2401 (f) Additional representations and warranties In addition to representations and warranties made and otherwise referenced in the Master Systems License, the Seller/Servicer represents and warrants to Freddie Mac that all data input into the System is true, complete and accurate and that all data is entered correctly. (g) Conditional waiver of liability With respect to a Mortgage for which the System is used to generate a recommended loss mitigation solution, if the Seller/Servicer is and remains in full compliance with the conditions set forth below, it will have no liability to Freddie Mac resulting from its

404-11 reasonable reliance on the accuracy of System calculations as evidenced by Resolve Output associated with the submission of that Mortgage to the System; provided, however, that the Seller/Servicer meets the following conditions (1) as of the submission date of all data and information required by the System for generation of Output with respect to that Mortgage, and (2) continuing through the Seller/Servicer’s final execution of the System’s recommended loss mitigation solution for such Mortgage: ■ All data, including, if applicable, Consumer Credit Data, entered into the System (I) is true, complete and accurate, (II) has been verified by the Seller/Servicer in accordance with the Loss Mitigation Business Rules, and (III) meets all eligibility and other requirements captured in the Loss Mitigation Business Rules ■ The Mortgage has successfully passed the eligibility requirements for an approved loss mitigation solution by the System ■ Prior to the final execution of the recommended loss mitigation solution for the Mortgage, the Seller/Servicer has resolved to Freddie Mac’s satisfaction all verification messages or conditions specified on the Feedback Certificate and any other Output ■ Prior to the execution of the recommended loss mitigation solution for the Mortgage, the Seller/Servicer has verified that all data and information on which the case submission was based remains unchanged for that Mortgage ■ The recommended loss mitigation solution is executed for that Mortgage in accordance with applicable requirements set forth in the Loss Mitigation Business Rules, including but not limited to, with the requirements of State mandated loan modification programs ■ The Seller/Servicer is in compliance with the Loss Mitigation Business Rules and all other provisions of the Guide, except with respect to calculations performed by the System; and ■ Without limiting the generality of Section 2401.1(h)(ii), the Seller/Servicer is and remains in compliance with all federal, State and local laws, rules and regulations applicable to its activities in connection with which the System is used
